Website Terms of Use

These terms apply when you use fernbrick.pages.dev (the "Website"), which is run by Kaushik Tripathi, trading as Fernbrick Studio ("we", "us", "our"), of D-54, Sector 58, Noida 201301, India. By using the Website, you agree to these terms. If you do not agree, please do not use the Website.

1. What the Website is for

The Website gives information about our website design, development, hosting and care plan services, shows examples of our work, and explains how to contact us by email to ask for a quote or arrange a call.

Nothing on the Website is an offer that becomes a contract when you accept it. Paid work is done only under a separate signed agreement (a Website Statement of Work and, where relevant, a Care Plan Agreement). If those documents conflict with these terms, those documents apply.

Prices, packages, timelines and service descriptions on the Website are general guidance. They may change, and they are only confirmed in a signed proposal or Statement of Work.

2. Who may use it

The Website is mainly for businesses and organisations. You must be at least 18 and, if you use the Website on behalf of a business, you must have authority to accept these terms for it.

3. Acceptable use

You agree not to:

  • break any law or anyone else's rights while using the Website;
  • try to hack, overload, disrupt or gain unauthorised access to the Website or our systems;
  • use bots, scrapers or other automated tools to copy content or extract data, except normal search engine indexing;
  • upload or send viruses or other malicious code;
  • send us spam, or false or misleading information;
  • pretend to be someone else.

We may block or limit access for anyone who breaks these rules.

4. Our content and intellectual property

We (or our licensors) own the Website and its content, including text, graphics, logos, design and code. You may view pages and share links for your own purposes (for example, sending a link to a colleague). You may not copy, republish, sell or create derivative works from our content without our written permission.

Fernbrick Studio and our logo are our trade names and trademarks. Third-party names and logos on the Website belong to their owners. Showing them does not mean they endorse us.

5. Portfolio

Our portfolio currently shows concept sites for fictional businesses, clearly labelled as concepts, until we have client work to show. These concepts show our design and build approach. They are not real businesses, and they do not describe results for any client. Nothing in our portfolio is a promise that your business will get any particular result.

6. Information you send us

When you send us information by email or during a call, you confirm that you are allowed to share it. We will use personal information as described in our Privacy Policy.

Please do not send passwords, login details or confidential information by email. If we start a project, we will agree a secure way to share access. Until we have signed an agreement with you, we cannot treat general enquiries as confidential (though we will always handle personal data in line with our Privacy Policy).

If you send us ideas or feedback about our Website or services, we may use them freely without paying you.

7. No advice and no guarantees

Content on the Website, including any guides, checklists and examples, is general information. It is not legal, tax, marketing or other professional advice. For example, a guide about privacy policies or accessibility does not replace advice from a qualified professional about your own website.

We provide the Website "as is" and "as available". To the extent the law allows, we do not promise that the Website will be uninterrupted, error-free, secure or free of viruses, or that its content is complete or up to date.

The Website may link to third-party websites and tools (such as hosting or payment providers). We do not control them and are not responsible for their content, terms or privacy practices.

9. Our liability

Use of the Website is free. To the extent the law allows:

  • we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data, business or goodwill arising from your use of the Website; and
  • our total liability to you for anything relating to the Website is limited to USD 100 (or GBP 100 if you are based in the UK).

Nothing in these terms limits or excludes any liability that cannot legally be limited or excluded, such as liability for fraud, or for death or personal injury caused by negligence. If you are a consumer, you may have rights under your local law that these terms do not affect.

10. Your responsibility

You are responsible for your use of the Website. To the extent the law allows, you agree to cover our reasonable losses and costs caused by your breach of these terms or your misuse of the Website.

11. Changes

We may update the Website and these terms at any time. The version posted on the Website when you use it applies. We will update the "Last updated" date when we make changes.

12. Governing law and disputes

These terms are governed by the laws of India. The courts of Gautam Buddh Nagar (Noida), Uttar Pradesh, India will have jurisdiction, but we may also bring proceedings in the courts of the country where you are based.

If you are a consumer, you keep the mandatory protections of the law of the country where you live, and you may also bring a claim in the courts where you live.

13. General

If any part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term immediately, we can still enforce it later. These terms, together with our Privacy Policy, are the whole agreement about your use of the Website.
